Drunk Driving or Cell Phones: What’s Worse?

Is drunk driving or talking on cell phones worse? Let’s put it another way. Would you rather be on a road with 100 other drivers that are drinking and driving, or with 100 drivers that are managing at least one cell phone?

Let’s say that the drivers that are just itching to get arrested for a DUI have had four beers over the last hour. They are all of an average weight, so we can safely assume that their blood alcohol level is above the legal limit (usually .08%). They are legally DUI, but they’re not “sloppy drunks”.

Let’s say that our chatty drivers are checking their emails while attempting to answer a call. They are certainly distracted, and their awareness of their surroundings is limited at best.

Is either group of drivers impaired? Are they capable of driving in a reasonable and rational manner?

I would argue that both groups’ abilities to drive in a reasonable manner is impaired. Neither has the capacity to operate their vehicles to the degree that they should be able to. I really wouldn’t want to be on a road with drunk drivers or cell phone users.

While we have DUI laws that are quick to throw away the keys of anyone that is convicted of drunk driving, laws that ban the use of cell phones (without hands free devices) are just beginning to be legislated, and the penalty for violating them is minimal at best. If you are convicted of drunk driving, you will probably spend a small fortune on the best DUI lawyers that you can find for your defense. If you get a ticket (big “if” there), you can just pay a little fine and finish up the legal battles in time to send another text message.

Personally, I would much rather be on a road with drunk drivers that have had four drinks. Don’t get me wrong here, I do not advocate drinking and driving or using a cell phone in a car. I just honestly believe that cell phones are much more dangerous.
