| I want to ask you guys about a DUI in Alaska, which is where I have lived all my life. Got a DUI this weekend. 1st time. was coming home and the officer traveling the opposite direction passed me and turned around to stop me. Said I was speeding. I don't have the police report yet, but as far as i can tell, he did not use radar to determine this, only judgment. He did not ticket me for speeding and there are no speed figures stated on any of the info i have. What are my chances of having this used as unlawful stop? Can a cop pull you over any time he wants, without even having a reading from a radar? That's just stupid to me! Last edited by Glenn Dorsey; 05-08-2008 at 07:12 PM. |

| Well, I think you are out of luck on this one. the arresting police officer doesn't have to arrest you for speeding, in addition to drinking and driving, for the DUI charge to "stick" in Alaska. His testimony at trial will likely be that he observed you driving rapidly, and that's good enough for a stop. He didn't have to use a radar detector, under Alaska law, to make that judgment call. Double check this please under the Alaska DUI laws. Good luck to you pal with the DWI charge!! P.S. I lived in Alaska for 3 years. The cops are quick to pull you over there. Other than that, I love the state.

| The cop that pulled me over for a DUI just said that I looked "funny". Isn't that a bunch of crap? I think the police can get away with just about anything. Maybe that's why they are called "pigs"??????????????
