| My question involves criminal law for the state of: Ohio My ohio driver's license was suspended for "a definite period of three years" by the judge for a dui accident case. I have done a year and half of the suspension. My question is- Is the judge legally allowed to modify the sentence to give me back full driving priviledges? The reason I ask is because the definite period is supposed to be between 2-10 years (4510.02(A)(2) http://codes.ohio.gov/orc/4510.02 However 4510.13 shows Restrictions on suspending suspension periods or granting limited driving privileges http://codes.ohio.gov/orc/4510.13. I believe my case falls under 4510.13(A)(2)(a) The charge was "aggravated vehicular assault" due to a pre-existing condition of the other driver. Thank you in advance for your answers |

| The judge should be able to modify his sentence of the suspension for your DUI. I'm pretty sure that your situation falls under Ohio statute 4510.13 Double check this please, but that does seem accurate. P.S. Do you know the judge in your DUI case, or do you have an inside track to getting him to modify the DUI sentence? Just curious.
