In every state in the U.S., the legal age to drink alcohol is now 21. If you are younger than 21, many states have a zero tolerance policy that sets a blood alcohol content level (BAC) that is much lower than the usual .08%. In these states, if you are less than 21 years of age and alcohol testing determines that you have been drinking and driving, you will be arrested for DUI. The DUI laws of every state determines the BAC for the zero tolerance policy, and some states do not have a lower level for underage drivers.
The following list shows the states that do have a zero tolerance policy for underage drivers, and the alcohol testing level that is considered to be illegal (which will result in an arrest for DWI):
